Application and Explanation of Use as a Legal Gateway
This Act places an obligation on an LA to meet a person’s care and support needs, subject to financial circumstances, should they fit one of five criteria. In doing so, the LA must gather a wide range of data about the person, including financial and other special category data.
This information may need to be shared with care / health providers, and, in the event a person moves, the LA that they are moving to. This includes individuals who are moving from Children’s Services where they have SEND. From 18, the Care part of an EHCP is met through Adult Care and Support.
