Section 21 of the Act, as amended by section 38 of the Education and Inspections Act 2006, places a duty on the governing body of a maintained school to promote the well-being of pupils at the school.
This can be seen in conjunction with the duties on LAs to promote the well-being of children as laid out in section 10 of the Children Act 2004.
It should also be noted that the guidance also applies to Independent schools by virtue of Section 157 of the Education Act 2002.
